Supreme Mess

My initial reaction to the Supreme Court's "resolution" of the Michigan affirmative action cases (here and here, if you can stand it) is that, by comparison, these two decisions make what formerly seemed to be the hopelessly confused, inconsistent mess of Bakke actually seem to shine with the transparency of reason.

It appears that the Court mostly wants public institutions everywhere to spend even more time, money and effort construing the Court's opaque, embarrassing extrusions in the field of affirmative action.
